Welcome to ExamKP! By accessing or using our Platform (website and mobile applications), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

These Terms constitute a legally binding agreement between you and ExamKP ("we," "us," or "our"). We reserve the right to modify these Terms at any time. Your continued use of the Platform after changes are posted constitutes acceptance of the modified Terms.

2. Description of Service

ExamKP is an online educational platform that provides:

• Practice questions and quizzes for WAEC, JAMB, NECO, and other exams
• Video and audio lessons
• Study groups and collaborative learning features
• Progress tracking and analytics
• Subscription-based premium content and features

We strive to provide accurate and up-to-date content but make no guarantees about the accuracy, completeness, or timeliness of the educational materials.

3. User Accounts

3.1 Registration

To use certain features of our Platform, you must create an account. You may register using:

• Email and password
• Google Sign-In (OAuth)
• Facebook Sign-In (OAuth)

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.

3.2 Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized access to your account
• You may not share your account with others or allow others to access your account

3.3 Age Requirements

You must be at least 13 years old to create an account. If you are under 18, you represent that you have parental or guardian consent to use the Platform.

4. Subscriptions and Payments

4.1 Subscription Plans

We offer various subscription plans with different features and pricing:

• Free Trial: Limited access to basic features
• Premium Plans: Full access to all content and features

4.2 Billing and Payment

• Subscriptions are billed in advance on a recurring basis (monthly or annually)
• Payment is processed through secure third-party payment processors (Paystack, Airtime2Cash)
• You authorize us to charge your payment method for the subscription fees
• All fees are non-refundable unless otherwise stated or required by law

4.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. You can cancel your subscription at any time through your account settings.

4.4 Price Changes

We reserve the right to change our subscription fees at any time. We will provide you with advance notice of any price changes. If you do not agree to the new pricing, you may cancel your subscription.

4.5 Refund Policy

Refunds are only available in the following circumstances:

• Duplicate charges due to system error
• Subscription not delivered due to technical issues on our end
• Within 7 days of first subscription purchase (one-time only)

5. User Conduct and Responsibilities

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Share, distribute, or resell Platform content without authorization
• Use automated systems (bots, scrapers) to access the Platform
• Attempt to gain unauthorized access to the Platform or other users' accounts
• Upload or transmit viruses, malware, or other malicious code
• Harass, abuse, or harm other users
• Post spam, offensive, or inappropriate content in study groups
• Use the Platform to cheat on actual exams
• Create multiple accounts to abuse trial periods or promotions

6. Intellectual Property Rights

6.1 Platform Content

All content on the Platform, including but not limited to text, graphics, logos, images, videos, audio, questions, quizzes, and software, is the property of ExamKP or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and its content for your personal, non-commercial educational purposes.

6.3 User-Generated Content

When you post content in study groups or other interactive features, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with the Platform.

7. Study Groups

Study groups are collaborative spaces for learning. When using study groups:

• You agree to be respectful and constructive in your interactions
• We are not responsible for user-generated content in study groups
• Group admins have the right to moderate content and remove members
• We reserve the right to remove any content or disband groups that violate these Terms

8. Third-Party Services and Content

Our Platform integrates with third-party services:

• Google OAuth: For sign-in and authentication
• Facebook OAuth: For sign-in and authentication
• YouTube: For video lesson content
• Payment Processors: For subscription processing

We are not responsible for the practices or content of these third-party services. Your use of such services is subject to their respective terms and privacy policies.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Platform will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, completeness, or timeliness of content
• Warranties that using the Platform will result in passing any exam

We do not guarantee any specific results from using our Platform. Your exam performance depends on many factors beyond our control.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ExamKP SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Damages resulting from your inability to use the Platform
• Damages resulting from unauthorized access to your account
• Damages resulting from errors or inaccuracies in Platform content

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless ExamKP and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of another party
• Content you post on the Platform

12. Termination

12.1 By You

You may terminate your account at any time by contacting us or through your account settings. Upon termination, your access to the Platform will cease, but you will not receive a refund for any unused subscription period.

12.2 By Us

We may suspend or terminate your account immediately, without notice, if you:

• Violate these Terms
• Engage in fraudulent or illegal activities
• Abuse or harm other users
• Fail to pay subscription fees

12.3 Effect of Termination

Upon termination, all licenses granted to you will immediately cease, and you must stop using the Platform. We may retain your information as required by law or for legitimate business purposes.

13. Changes to the Platform

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without notice or liability. We may also change features, pricing, or content availability.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Platform shall be resolved through:

• First, good faith negotiation between the parties
• If unresolved, binding arbitration in accordance with Nigerian arbitration law
• The courts of Nigeria shall have exclusive jurisdiction

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ExamKP regarding your use of the Platform.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

15.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
